Terms & Conditions

These terms and conditions shall apply to any purchase of any goods and/or services from Lex Blinds. These terms together with the Buyer‘s order will constitute an agreement for the supply and purchase of goods and/or services.
By entering into an agreement with Lex Blinds the Buyer warrants that the Buyer has the right to conclude an agreement with Lex Blinds to supply the goods and services at the property where they are to be delivered and installed.

1. Ordering and delivery of goods

1.1. Before the conclusion of an agreement or the placement of an order, Lex Blinds undertakes to provide the Buyer with the necessary, accurate and complete information about the products being sold.
1.2. Lex Blinds undertakes, prior to the ordering of goods, to enable the Buyer to inspect the product, to check its functionality, or to demonstrate how to use it, if this is possible due to the nature of the product or the type of agreement, order.
1.3. Buyers may claim the ordered goods at the office of Lex Blinds.
1.4. Lex Blinds offers home delivery services throughout the territory of the United Kingdom. The delivery price is determined according to the delivery address indicated by the Buyer.
1.5. When ordering home delivery, the Buyers undertake to indicate the exact and correct address of delivery and contact details of the Buyer to Lex Blinds. The Buyer shall be liable for the correctness of the delivery and contact information, as well as possible losses of the Buyer or Lex Blinds resulting from the submission of incorrect data.
1.6. Lex Blinds products are made-to-measure, therefore they are subject to longer manufacturing and delivery periods. Lex Blinds undertakes to deliver products to the Buyer according to the terms detailed in the Buyer’s order or agreement, however, Lex Blinds shall not be liable for any losses the Buyer may incur due to Lex Blinds not being able to deliver the products in time, because of circumstances beyond Lex Blinds reasonable control.
1.7. In order to ensure safe working practices, it is a condition of these terms that the area in which the works are to be carried out is cleared of, without limitation, pets, plants, furniture, breakable items, and household residents.
1.8. Cancellations made less than 48 hours before a scheduled installation appointment will incur a charge of £300 payable upon completion of the rescheduled appointment.
1.9. Should Lex Blinds be in a situation where they are not able to fulfill installation of all Products in an order, Lex Blinds shall be entitled to perform partial installation of the order and receive a payment of the products that have been installed.
1.10. On delivery, the Buyer signs a consignment note or other acceptance-transfer document, confirming that the goods have been properly delivered.
1.11. On delivery, the Buyer must check the condition of the shipment. If the shipment would be damaged, the Buyer must describe it in the consignment note or in another acceptance-transfer document. Once the Buyer signs the consignment note or other acceptance-transfer document without comments, it is deemed that the shipment was delivered without damages or other violations.
1.12. Any manufacturing defects or issues must be notified to Lex Blinds within 72 hours of delivery or installation.
1.13. Lex Blinds may suspend the supply of any product the Buyer has ordered to ensure the product complies with any changes in relevant laws.
1.14. If for any reason Lex Blinds is required to make more significant changes than those set out above to any of the product the Buyer has ordered, which will affect the Buyer’s use of such product, Lex Blinds will notify the Buyer and the Buyer may then terminate the agreement before the changes are made and receive a full refund.
1.15. If any alteration takes place to the area after original measurements are taken that would affect installation, the Buyer will then be held liable for payment to alter/remake the goods and re-installation.
1.16. Any minor variation between samples and/or descriptions provided by Lex Blinds and the products delivered shall not entitle the Buyer to:
1.16.1. reject the products;
1.16.2. reduce the price of the products;
1.16.3. claim compensation.

2. Our contract with you

2.1. Any quotation given by us shall not constitute an order, and is only valid for a period of 90 business days from its date of issue. We may extend this period at our discretion.

3. Price and payment

3.1. The price for the goods and services to be supplied is stated on the Order Confirmation. All prices are inclusive of the cost of delivery and VAT.
3.2. If the rate of VAT changes between your order date and the date we supply the product(s) you have ordered, we will adjust the rate of VAT that you pay, unless you have already paid for the product(s) in full before the change in the rate of VAT takes effect.
3.3. A deposit (which is 50% of the agreed price) shall be payable by you upon signing the Order Confirmation or on confirming your acceptance of the order. Full payment will be due upon collection or on the day of installation unless otherwise agreed with Lex Blinds in writing.
3.4. If the client is late to settle their invoice by 30 days or more, Lex Blinds will add a late payment fee charge of £100. After this charge, statutory interest on overdue invoices will be charged at 8,5% rate until the outstanding balance is settled in full.

4. Our warranty to you

4.1. We offer a 2-year warranty on all our indoor products, up to a 5-year warranty on all our outdoor products and a 10-year warranty on shutters excluding: improper use, fair wear and tear, factors beyond Lex Blinds control.
4.2. We warrant that any goods supplied will correspond with the specification set out in the Order Confirmation or the Technical Order Confirmation Form (as the case may be) at the time of delivery or supply, will be of satisfactory quality and will be fit for the purpose for which they are commonly bought and for the purpose for which they have been designed; and we warrant that the services supplied will be performed with reasonable skill and care.
4.3. Subject to clauses 4.4 to 4.7 below, and to the receipt of payment in full for your order: Lex Blinds warrant that, for a period of 12 months from the date of installation, all goods and services supplied will be free from defects in materials and workmanship; and in addition to your statutory rights for awnings, shutters and conservatory blind systems, we offer the “Peace of Mind Package”, which is an extended care plan that covers the period from the first to the fifth anniversary of the installation date where we will, subject to a £75 call out charge, repair or replace defective goods free of charge (always providing that the goods have not been subject to any misuse or modification).
4.4 If any services supplied by us are not in accordance with clause 4.2 or 4.3 above, you should notify us in writing within a reasonable time from their supply or of becoming aware of the defects which are not apparent to you on a reasonable inspection of the services. We will either arrange with you a time when we can visit your home to examine the supplied services or request imagery showing the alleged defect and, if the services are not in compliance with clause 4.2 or 4.3 above, we will either remedy the defect in question or re-supply the defective services.
4.5. All fabrics supplied by Lex Blinds are tested in accordance with BS EN ISO 105 B02 and are subject to colour fading. The warranties set out in these terms and conditions shall not apply to colour fading caused by the normal use of the products.
4.6. In order for Lex Blinds to remedy the defects of a supplied product, Lex Blinds will require access to the Buyer’s property, where the product is installed. If the Buyer does not provide Lex Blinds access to the product within a reasonable time, it will be deemed as a breach of agreement and the Lex Blind warranty as set out within these terms and conditions shall no longer apply.
4.7. The Product warranties set out in these terms and conditions are for the original Buyer only and are not transferable. In order for the original Buyer to present a claim under the provided warranty, the Buyer must present Lex Blinds with an order confirmation or agreement.

5. Order cancellation

5.1. Lex Blinds products fall into the category of goods that are made to the consumer’s specifications or are clearly personalised under the Consumer Contracts Regulations 2013. Therefore, after placing an order, the Buyer will not have the right to cancel such an order.
5.2. Notwithstanding clause 4.1 above, Lex Blinds will accept the cancellation of an order once placed if the Buyer’s notice of cancellation is received within 24 hours starting with the date the Buyer’s order is placed. The notice of cancellation must be presented to Lex Blinds by email to welcome@lexblinds.co.uk or at Lex Blinds offices, after which any agreement will be terminated from the date the notice is presented.
5.3. If the Buyer cancels the order under clause 4.2. Lex Blinds will refund any payments the Buyer has made.

6. Other important terms

6.1. Lex Blinds may terminate the agreement at any time by written notice if the Buyer:
6.1.1. does not make due payments to Lex Blinds and the Buyer does not make due payments within 14 days of Lex Blinds written reminder;
6.1.2. does not, within a reasonable time, provide information necessary for Lex Blinds to manufacture and supply an ordered product;
6.1.3. does not, within a reasonable time, allow Lex Blinds to deliver and/or install the ordered products on the Buyer’s property.
6.2. If Lex Blinds terminates the agreement in any of the cases set out in clause 5.2. and the manufacturing of the product the Buyer has ordered has already begun, Lex Blinds will not refund any money the Buyer has paid in advance for such product.
6.3. Discounts provided and advertised by Lex Blinds shall only apply to the products and services as specified in the according to discount information. Lex Blinds may refuse to apply discounts if certain conditions, specified in the discount information, are not met and all discounts/offers are subject to availability. Lex Blinds reserves the right to change any discount terms, including cancelation of any discounts without prior notice. Please note, our 10% off discount can only be used for the first order placed with us and cannot be used in conjunction with any other offer‚ voucher‚ discount or standard promotion. Minimum order to apply for the 10% first order discount is £500. For this promotion maximum discount possible for the order is £200.
6.4. Should a customer require a repair, we’ll repair or replace as appropriate in accordance with the agreed terms, however there will be a call-out charge fee that will be refunded within 7 – 10 working days if our installed product is at fault and it’s covered by a warranty. If the fault isn’t with Lex Blinds products or we have to carry out the work at a time not covered by the warranty, then a call out charge will not be refunded.
